Dallas Failure to Identify Lawyer

Failure to identify yourself to a police officer is a class C misdemeanor, punishable by a fine of up to $500.  If you’re detained, you’re required to provide your full legal name, place of residence, and your birthdate.  Also, you can be charged with failure to identify if you provide false information as to your identity to a peace officer.

Penalty Range

Under these facts, failure to identify is a class B misdemeanor, with a penalty range of up to 180 days in the county jail, and a fine up to $2000.  At the time of the offense, if you have any warrants out for your arrest, the penalty ranges increase for each aforementioned offense.

In these circumstances, failure to identify by refusing to give information is enhanced to a Class B misdemeanor, and failure to identify if you are a fugitive (i.e., you have a warrant out for your arrest) becomes a Class A misdemeanor, which includes a penalty range of up to one year in the county jail, and up to a $4000 fine.
