Dallas Possession of a Prohibited Weapon Lawyer

Possession of a prohibited weapon is a criminal offense in which it’s alleged that you had care, custody or control of a weapon that is prohibited by statute.  Prohibited weapons include machine guns, switchblades, sawed off shotguns, brass knuckles, zip guns, or armor-piercing ammunition.  Possession of a prohibited weapon such as a set of brass knuckles, or a switchblade, will result in your being charged with a class A misdemeanor allegation of possession of a prohibited weapon, which carries a penalty of up to one year in the county jail, and a fine of up to $4000. 

Third Degree Felonies can Result?

If you’re alleged to be in possession of a prohibited weapon of any other description, the offense is a third degree felony.  In Texas third degree felonies can result in a prison sentence of between two and twenty years, as well as a fine of up to $10,000. Under certain circumstances, you may be entitled to a defense to the charge of possession of a prohibited weapon

For instance, you may lawfully possess a weapon that would otherwise be prohibited if you did so as part of your official duty.  Also, in some cases, it’s lawful to possess an otherwise prohibited weapon if you’re doing so a collector, and for no other purpose.
